Article R1221-18 of the French Labour Code

On the basis of the data in the pre-employment declaration sent to it by the body referred to in Article R. 1221-3, the Caisse nationale d’assurance vieillesse des travailleurs salariés (National Old-Age Insurance Fund for Employees) verifies that the employee’s registration number in the national register for the identification of natural persons (NIR) or the pending identification number (NIA) shown on the said declaration corresponds to the civil status data shown on the same declaration.

If there is no registration number in the national register for the identification of natural persons and no pending identification number or if the registration number in the national register for the identification of natural persons or the pending identification number is incorrect in the pre-employment declaration, the Caisse nationale d’assurance vieillesse des travailleurs salariés will send the body mentioned in Article R. 1221-3 an identification report including, where it has been able to find it, the registration number for the national register of identification of natural persons or the standby identification number to be used. The body mentioned in the aforementioned article notifies the employer of the availability of this identification report so that, in particular, it can rectify or complete the data transmitted in the nominative social declaration.

A partir des données de la déclaration préalable à l’embauche que lui transmet l’organisme mentionné à l’article R. 1221-3, la Caisse nationale d’assurance vieillesse des travailleurs salariés vérifie que le numéro d’inscription au répertoire national d’identification des personnes physiques (NIR) ou le numéro d’identification d’attente (NIA) du salarié porté sur ladite déclaration correspond aux données d’état civil qui figurent sur cette même déclaration.

En cas d’absence de numéro d’inscription au répertoire national d’identification des personnes physiques et de numéro d’identification d’attente ou en cas de numéro d’inscription au répertoire national d’identification des personnes physiques ou de numéro d’identification d’attente erroné dans la déclaration préalable à l’embauche, la Caisse nationale d’assurance vieillesse des travailleurs salariés renvoie à l’organisme mentionné à l’article R. 1221-3 un bilan d’identification comprenant, lorsqu’elle a pu retrouver celui-ci, le numéro d’inscription au répertoire national d’identification des personnes physique ou numéro d’identification d’attente à utiliser. L’organisme mentionné à l’article précité avise l’employeur de la disponibilité de ce bilan d’identification afin que, notamment, il rectifie ou complète les données transmises dans la déclaration sociale nominative.
