Article R1231-8 of the French Public Health Code

The donor sends the committee of experts referred to in article R. 1231-5 a request for authorisation to carry out the removal, where applicable in the context of a cross-donation, together with a copy of the document in which his consent was obtained.

The committee of experts shall carry out all the investigations and consultations it deems necessary to inform its decision. It may request written or oral explanations from the doctor who is to carry out the removal, the doctor in charge of the service, department or care structure in which the removal is to be carried out or the doctor who has indicated the need for a transplant.

Le donneur adresse au comité d’experts mentionné à l’article R. 1231-5 une demande d’autorisation de prélèvement, le cas échéant dans le cadre d’un don croisé, qu’il accompagne d’une copie de l’acte par lequel a été recueilli son consentement.

Le comité d’experts procède à toutes les investigations et à toutes les consultations qu’il estime nécessaires pour éclairer sa décision. Il peut solliciter les explications écrites ou orales du médecin qui doit procéder au prélèvement, du médecin responsable du service, du département ou de la structure de soins dans lequel le prélèvement doit être effectué ou du médecin qui a posé l’indication de greffe.
