Article R1233-3-3 of the French Labour Code

Disputes relating to the expert appraisal provided for in article L. 1233-34 must be duly substantiated and sent to the regional director of companies, competition, consumption, labour and employment with territorial jurisdiction, by any means that can provide a date certain:

1° By the employer, with regard to the choice of the expert, the need, the estimated cost, the scope and the duration of the expert assessment;

2° By the social and economic committee when the conditions set out in articles L. 2315-82 and L. 2315-83 are not met.

The Regional Director shall give his decision within five days of receipt of the request. A copy of the decision is sent to the other parties.

Les contestations relatives à l’expertise prévue à l’article L. 1233-34 doivent être dûment motivées et adressées au directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi territorialement compétent, par tout moyen permettant de conférer une date certaine :


1° Par l’employeur, s’agissant du choix de l’expert, de la nécessité, du coût prévisionnel, de l’étendue, de la durée de l’expertise ;


2° Par le comité social et économique lorsque les conditions fixées aux articles L. 2315-82 et L. 2315-83 ne sont pas réunies.


Le directeur régional se prononce dans un délai de cinq jours à compter de la date de réception de la demande. Une copie de la décision est adressée aux autres parties.
