When the draft collective agreement on the Collective Agreement on Termination of Employment includes establishments falling under the jurisdiction of several Regional Directors of Enterprise, Competition, Consumer Affairs, Labour and Employment, the employer informs the Regional Director of the head office of the company of its intention to open negotiations in application of article L. 1237-19.
The competent Regional Director of Companies, Competition, Consumption, Labour and Employment is the one in whose area of jurisdiction the following are located:
1° The head office of the company;
2° The head office of the main company in the case of an economic and social unit;
3° The head office of the dominant company in the case of a group agreement;
4° The branch with the highest number of jobs concerned in the case of an international company with its head office abroad.
The regional director concerned shall inform the employer of its competence by any means that can be relied upon to provide a date certain. The employer informs, without delay and by any means, the Social and Economic Committee and the representative trade unions.
