Article R1253-21 of the French Labour Code

To be approved, an employers’ group must meet the following conditions:
1° The collective agreement it intends to apply must be the one best suited to the activity of its various members and to the jobs performed by its employees;
2° Its articles of association must define the geographical area in which the employment contracts of the employees it intends to employ will be executed and provide that these contracts will contain clauses taking into account the hardships associated with changes in the place of employment and the duration of the employees’ assignments.

Pour être agréé, le groupement d’employeurs doit répondre aux conditions suivantes :
1° La convention collective qu’il entend appliquer doit être la mieux adaptée à l’activité de ses différents membres et aux emplois exercés par ses salariés ;
2° Ses statuts doivent définir la zone géographique d’exécution des contrats de travail des salariés qu’il envisage d’employer et prévoir que ces contrats contiendront des clauses prenant en compte les sujétions liées aux changements de lieux d’emploi et à la durée des missions de ces salariés.
