Article R1261-24 of the French Public Health Code

The activities covered by the agreement provided for in article R. 1261-21 may not be a source of profit for the parties.

The terms and conditions of the financial participation of entities outside the authorised establishment shall compensate for the costs incurred by the latter for the preservation and, where applicable, the transport of the body.

The board of directors of the authorised establishment, or the body acting in its stead, shall determine the terms and conditions of this financial participation.

The activities organised in partnership with an external entity are ancillary to the other training or research activities of the structure receiving donations from the establishment authorised in accordance with the second paragraph of article L. 1261-1.

The agreement is concluded in accordance with the legislative and regulatory provisions applicable to the establishment.

Les activités faisant l’objet de la convention prévue par l’article R. 1261-21 ne peuvent être source d’aucun profit pour les parties.

Les modalités de la participation financière des entités extérieures à l’établissement autorisé compensent les frais engagés par ce dernier pour la conservation et, le cas échéant, le transport du corps.

Le conseil d’administration de l’établissement autorisé, ou l’organe en tenant lieu, détermine les modalités de cette participation financière.

Les activités organisées en partenariat avec une entité extérieure présentent un caractère accessoire par rapport aux autres activités de formation ou de recherche de la structure d’accueil des dons de l’établissement autorisé conformément au deuxième alinéa de l’article L. 1261-1.

La convention est conclue conformément aux dispositions législatives et réglementaires applicables à l’établissement.
