Where the account holder is subject to compulsory registration in the Trade and Companies Register or the National Register of Companies as a business in the trades and crafts sector and the amount of the unpaid cheque exceeds an amount determined by joint order of the Minister of Justice, Minister of Justice, and the Minister for the Economy, the drawee shall notify the clerk of the commercial court or, where applicable, of the judicial court ruling in commercial matters within whose jurisdiction the account holder is domiciled, of the certificate of non-payment drawn up pursuant to article L. 131-73.
The certificate of non-payment is published by the Registrar in accordance with the conditions set out in articles L. 511-56 to L. 511-60 of the French Commercial Code and the regulatory provisions adopted for their application, and in articles R. 511-2 to R. 511-11 of the French Commercial Code.
