Article R131-49 of the French Monetary and Financial Code

Where the account holder is subject to compulsory registration in the Trade and Companies Register or the National Register of Companies as a business in the trades and crafts sector and the amount of the unpaid cheque exceeds an amount determined by joint order of the Minister of Justice, Minister of Justice, and the Minister for the Economy, the drawee shall notify the clerk of the commercial court or, where applicable, of the judicial court ruling in commercial matters within whose jurisdiction the account holder is domiciled, of the certificate of non-payment drawn up pursuant to article L. 131-73.

The certificate of non-payment is published by the Registrar in accordance with the conditions set out in articles L. 511-56 to L. 511-60 of the French Commercial Code and the regulatory provisions adopted for their application, and in articles R. 511-2 to R. 511-11 of the French Commercial Code.

Lorsque le titulaire du compte est soumis à l’obligation d’immatriculation au registre du commerce et des sociétés ou au Registre national des entreprises en tant qu’entreprise du secteur des métiers et de l’artisanat et que le montant du chèque impayé est supérieur à un montant déterminé par arrêté conjoint du garde des sceaux, ministre de la justice, et du ministre chargé de l’économie, le tiré dénonce au greffier du tribunal de commerce ou, le cas échéant, du tribunal judiciaire statuant en matière commerciale dans le ressort duquel se trouve le domicile du titulaire du compte, le certificat de non-paiement établi en application de l’article L. 131-73.

Le certificat de non-paiement fait l’objet d’une publicité par le greffier dans les conditions fixées par les articles L. 511-56 à L. 511-60 du code de commerce et les dispositions réglementaires prises pour leur application et par les articles R. 511-2 à R. 511-11 du code du commerce.
