Article R131-8 of the French Monetary and Financial Code

The Banque de France’s reply is sent without delay to the person consulting the file. In the case of a proxy, the proxy shall inform the principal without delay.

When the Banque de France finds that a cheque has not been properly issued for one of the reasons mentioned in the first paragraph of Article R. 131-5, it informs the person who consulted the file without indicating the nature of the irregularity, records all the identification details mentioned in Article R. 131-7 and keeps them for a minimum period of two months.

La réponse de la Banque de France est transmise sans délai à la personne qui consulte le fichier. S’il s’agit d’un mandataire, celui-ci en informe sans délai son mandant.

Lorsque la Banque de France constate que l’émission d’un chèque n’est pas régulière pour une des causes mentionnées au premier alinéa de l’article R. 131-5, elle en informe la personne qui a consulté le fichier sans indiquer la nature de l’irrégularité, enregistre l’ensemble des éléments d’identification mentionnés à l’article R. 131-7 et les conserve pendant une durée minimale de deux mois.
