Article R134-1 of the French Insurance Code

The amount of the guaranteed capital or the capital constituting the guaranteed annuity payable at maturity mentioned in article L. 134-1 may not exceed an amount determined according to mortality tables and rates applicable to the pricing of this guarantee defined by order of the Minister for the Economy.

The contract stipulates that the diversification reserve cannot be less than a minimum value which it defines. This value is strictly positive and expressed in euros.

An order of the Minister responsible for the economy determines the name and minimum conditions, particularly with regard to maturity and the level of capital guarantee, which the life insurance and capitalisation contracts referred to in article L. 134-1 must meet in order to benefit from this name in deeds and documents intended for third parties.

Le montant du capital garanti ou du capital constitutif de la rente garantie payable à échéance mentionnés à l’article L. 134-1 ne peut excéder un montant déterminé selon des tables de mortalité et des taux applicables à la tarification de cette garantie définis par arrêté du ministre chargé de l’économie.

Le contrat prévoit que la part de provision de diversification ne peut être inférieure à une valeur minimale qu’il définit. Cette valeur est strictement positive et exprimée en euros.

Un arrêté du ministre chargé de l’économie détermine une dénomination et les conditions minimales, s’agissant notamment de l’échéance et du niveau de garantie en capital, que les contrats d’assurance sur la vie et de capitalisation mentionnés à l’article L. 134-1 doivent respecter pour bénéficier de cette dénomination dans les actes et documents destinés aux tiers.
