Article R1413-2 of the French Public Health Code

In order to carry out its missions, the National Public Health Agency may in particular:

1° Acquire the necessary movable and immovable property;

2° Allocate, from its own budget, grants, loans or advances to public or private bodies carrying out studies, research, work, equipment or works contributing to the fulfilment of its missions;

3° To enter into agreements or participate in public interest groupings with any public or private entity, whether French or foreign;

4° Set up a central purchasing body, governed by the provisions of article 26 of order no. 2015-899 of 23 July 2015 relating to public contracts, when this proves to be the most appropriate solution for responding to exceptional health situations.

Pour l’exercice de ses missions, l’Agence nationale de santé publique peut notamment :

1° Acquérir les biens meubles et immeubles nécessaires ;

2° Attribuer, sur son budget propre, des subventions, prêts ou avances aux personnes publiques ou privées qui réalisent des études, recherches, travaux, équipements ou ouvrages concourant à l’accomplissement de ses missions ;

3° Conclure des conventions ou participer à des groupements d’intérêt public avec toute personne publique ou privée, française ou étrangère ;

4° Se constituer en centrale d’achat, régie par les dispositions de l’article 26 de l’ordonnance n° 2015-899 du 23 juillet 2015 relative aux marchés publics, lorsque cette modalité s’avère la solution la plus adaptée pour répondre à des situations sanitaires exceptionnelles.
