Article R1424-2 of the French General Code of Local Authorities

In the six months preceding the renewal of the representatives of the municipalities and public establishments for inter-municipal cooperation, the Board of Directors deliberates on:

a) The distribution of seats between, on the one hand, the département and, on the other hand, the communes and public establishments for inter-communal cooperation in accordance with the provisions of the second paragraph of article L. 1424-24-1 and of article L. 1424-26 ;

b) The weighting of the votes allocated to each mayor and to each president of a public establishment for inter-communal cooperation under the conditions set out in l’article L. 1424-24-3.

Proposals to this effect shall be submitted to the members of the Board of Directors at least fifteen days prior to deliberation.

In application of this deliberation, the chairman of the board of directors decides on the distribution of seats and the weighting of votes.

Dans les six mois qui précèdent le renouvellement des représentants des communes et des établissements publics de coopération intercommunale, le conseil d’administration délibère sur :

a) La répartition des sièges entre, d’une part, le département, et, d’autre part, les communes et les établissements publics de coopération intercommunale conformément aux dispositions du deuxième alinéa de l’article L. 1424-24-1 et de l’article L. 1424-26 ;

b) La pondération des suffrages attribués à chaque maire et à chaque président d’établissement public de coopération intercommunale dans les conditions fixées à l’article L. 1424-24-3.

Les membres du conseil d’administration sont saisis de propositions en ce sens quinze jours au moins avant de délibérer.

En application de cette délibération, le président du conseil d’administration arrête la répartition des sièges et la pondération des suffrages.
