Article R1424-56 of the French General Code of Local Authorities

For the application to the department of Bouches-du-Rhône of Chapter V “External fire defence” of Title II of Book II of Part Two, III of article R. 2225-3 is replaced by the following provisions:

III.These regulations are drawn up by the departmental fire and rescue service and the Marseille marine fire brigade in accordance with the powers devolved to them by articles L. 1424-2 et L. 1424-7. It is drawn up in consultation with the mayors and all those involved in outdoor fire protection.

The Bouches-du-Rhône departmental fire safety regulations have three parts:

1° A section specific to the area covered by the Marseille marine fire brigade, drawn up by the latter and approved by the departmental prefect after consulting the Marseille town council;

2° A section specific to the rest of the department, drawn up by the departmental fire and rescue service and approved by the departmental prefect after consulting the board of directors of the departmental fire and rescue service;

3° Where necessary, a joint section drawn up jointly by the Marseille marine fire brigade and the departmental fire and rescue service and approved by the departmental prefect after consultation with the Marseille city council and the board of directors of the departmental fire and rescue service.

It is modified and revised at the initiative of the departmental prefect under the conditions defined in the previous paragraphs.

Pour l’application au département des Bouches-du-Rhône du chapitre V “ Défense extérieure contre l’incendie ” du titre II du livre II de la deuxième partie, le III de l’article R. 2225-3 est remplacé par les dispositions suivantes :

III.-Ce règlement est élaboré par le service départemental d’incendie et de secours et le bataillon de marins-pompiers de Marseille conformément aux compétences qui leur sont dévolues par les articles L. 1424-2 et L. 1424-7. Il est établi en concertation avec les maires et l’ensemble des acteurs concourant à la défense extérieure contre l’incendie.

Le règlement départemental de défense extérieure contre l’incendie des Bouches-du-Rhône comprend trois volets :

1° Un volet propre au périmètre d’intervention du bataillon de marins-pompiers de Marseille, élaboré par ce dernier et arrêté par le préfet de département après avis du conseil municipal de Marseille ;

2° Un volet propre au reste du département élaboré par le service départemental d’incendie et de secours et arrêté par le préfet de département après avis du conseil d’administration du service départemental d’incendie et de secours ;

3° En tant que de besoin, un volet commun élaboré conjointement par le bataillon de marins-pompiers de Marseille et le service départemental d’incendie et de secours et arrêté par le préfet de département après avis du conseil municipal de Marseille et du conseil d’administration du service départemental d’incendie et de secours.

Il est modifié et révisé à l’initiative du préfet de département dans les conditions définies aux alinéas précédents.
