Article R1431-14 of the French General Code of Local Authorities

The duties of director are incompatible with an elected office in one of the local authorities that are members of the establishment and with any office in a grouping that is a member of it, as well as with those of a member of the board of directors of the establishment.

The director may not take or retain any interest in companies related to the institution, hold any position in these companies, or provide services on their behalf, with the exception of the institution’s subsidiaries.

If, after being given the opportunity to present his/her observations, it is found that he/she has failed to comply with these rules, the director shall be automatically removed from office by the board of directors.

Les fonctions de directeur sont incompatibles avec un mandat électif dans l’une des collectivités territoriales membres de l’établissement et avec toute fonction dans un groupement qui en est membre ainsi qu’avec celles de membre du conseil d’administration de l’établissement.

Le directeur ne peut prendre ou conserver aucun intérêt dans les entreprises en rapport avec l’établissement, occuper aucune fonction dans ces entreprises, ni assurer des prestations pour leur compte, à l’exception des filiales de l’établissement.

Si, après avoir été mis à même de présenter ses observations, il est constaté qu’il a manqué à ces règles, le directeur est démis d’office de ses fonctions par le conseil d’administration.
