Article R1442-2 of the French Labour Code

For the establishments and bodies mentioned in 2° and 3° of article D. 1442-1, the benefit of the provisions of articles D. 1442-3 and D. 1442-4 as well as access for salaried labour tribunal members to the rights provided for in the second paragraph of article L. 1442-6 are subject to approval by the Minister responsible for labour.

Approval, obtained by decree, is granted for a period of four years. It may be withdrawn at the end of each calendar year depending on the results of the checks carried out. These provisions do not preclude the possible termination of the agreements provided for in article D. 1442-3.

The establishment or organisation submits an application for approval drawn up in accordance with a model laid down by order of the Minister of Justice and the Minister for Employment.

Pour les établissements et organismes mentionnés aux 2° et 3° de l’article D. 1442-1, le bénéfice des dispositions des articles D. 1442-3 et D. 1442-4 ainsi que l’accès pour les conseillers prud’hommes salariés aux droits prévus au second alinéa de l’article L. 1442-6 sont subordonnés à l’agrément du ministre chargé du travail.

L’agrément, obtenu par voie d’arrêté, est donné pour une période de quatre ans. Il peut être retiré à la fin de chaque année civile en fonction des résultats des contrôles réalisés. Ces dispositions ne font pas obstacle à la dénonciation éventuelle des conventions prévues à l’article D. 1442-3.

L’établissement ou l’organisme présente un dossier de demande d’agrément établi conformément à un modèle fixé par arrêté du garde des sceaux, ministre de la justice, et du ministre chargé du travail.
