Article R1442-22-8 of the French Labour Code

When referring a case to the Commission or its Chairman pursuant to Articles L. 1442-13-3 or L. 1442-16, the Minister for Justice or the First President of the Court of Appeal in whose jurisdiction the accused councillor sits sends the Chairman of the Commission all the documents relating to the proceedings.

Lorsqu’il saisit la commission ou son président en application des articles L. 1442-13-3 ou L. 1442-16, le garde des sceaux, ministre de la justice ou le premier président de la cour d’appel dans le ressort de laquelle siège le conseiller prud’homme mis en cause transmet au président de la commission toutes les pièces afférentes à la poursuite.
