Article R1454-29 of the French Labour Code

In the event of a tie vote before the judgement committee or the conciliation and referral committee, the case is referred to a subsequent hearing of the judgement committee. This hearing, presided over by the deciding judge, is held within one month of the referral.

In the event of a tie in the summary proceedings panel, the case is referred to a hearing presided over by the judge hearing the case. This hearing is held without delay and at the latest within fifteen days of the referral.

En cas de partage des voix devant le bureau de jugement ou le bureau de conciliation et d’orientation, l’affaire est renvoyée à une audience ultérieure du bureau de jugement. Cette audience, présidée par le juge départiteur, est tenue dans le mois du renvoi.

En cas de partage des voix au sein de la formation de référé, l’affaire est renvoyée à une audience présidée par le juge départiteur. Cette audience est tenue sans délai et au plus tard dans les quinze jours du renvoi.
