Article R1511-45 of the French General Code of Local Authorities

The agreements referred to in the first paragraph of I of article L. 1511-8 shall be concluded between the health professional or the managing body of the health centre receiving the aid, the group(s) or local authority(ies) which allocate(s) the aid and the regional union of health insurance funds.

They specify in particular:

1° The commitments made by the beneficiary in return for the aid granted, which must include a commitment to practice effectively in an area defined pursuant to article L. 162-47 of the Social Security Code for a minimum period of three years;

2° The conditions under which the aid ends, in particular when the beneficiary’s place of establishment ceases to be included in a zone defined pursuant to article L. 162-47 of the Social Security Code, as well as the conditions under which the interested party undertakes, in the event of non-compliance with his commitments, to repay all or part of the aid received.

Les conventions mentionnées au premier alinéa du I de l’article L. 1511-8 sont conclues entre le professionnel de santé ou l’organisme gestionnaire du centre de santé bénéficiaire des aides, le ou les groupements ou collectivités qui attribuent les aides et l’union régionale des caisses d’assurance maladie.

Elles précisent notamment :

1° Les engagements pris par le bénéficiaire en contrepartie des aides accordées, qui incluent obligatoirement l’engagement d’exercice effectif dans une zone définie en application de l’article L. 162-47 du code de la sécurité sociale pour une période minimale de trois ans ;

2° Les conditions dans lesquelles les aides prennent fin, notamment lorsque le lieu d’installation du bénéficiaire cesse d’être inclus dans une zone définie en application de l’article L. 162-47 du code de la sécurité sociale, ainsi que les conditions dans lesquelles l’intéressé s’oblige, en cas de non-respect de ses engagements, à restituer, en tout ou en partie, les aides perçues.
