Article R*160-6 of the French Insurance Code

Where two years have elapsed from the date of the objection and no third party holder has come forward, the objector may, on production of a simple letter from the company certifying that the objection has not been contradicted, apply to the president of the judicial court, in the case of a capitalisation or savings certificate, for authorisation to have a duplicate of the contract issued to him at his own expense and to exercise the rights attached thereto.

As far as the company is concerned, the duplicate replaces the original, which can no longer be invoked against it, and the dispossessed holder retains the remedies available under ordinary law.

Lorsque se sont écoulées deux années à compter du jour de l’opposition sans qu’un tiers porteur se soit révélé, l’opposant peut, sur production d’une simple lettre de l’entreprise attestant que l’opposition n’a pas été contredite, demander au président du tribunal judiciaire, s’il s’agit d’un titre de capitalisation ou d’épargne, l’autorisation de se faire délivrer, à ses frais, un duplicata du contrat et exercer les droits qu’il comporte.

Au regard de l’entreprise, le duplicata est substitué à l’original qui ne lui est plus opposable, le porteur dépossédé conservant à l’égard de tous autres les recours du droit commun.
