As an exception to the provisions of sections 1 to 3, the Minister responsible for culture issues a cinematographic exhibition licence under the conditions set out in this sub-section:
1° Either for an unlimited number of screenings and, except in the case of school screenings, for a period not exceeding five years from the date of issue, to a work or document consisting of a recording of a live performance or a cultural event, including when this recording gives rise to a live or slightly deferred retransmission of the performance or event. If this work or document includes images other than those of the performance or event, these images do not represent more than 10% of the total duration of the work or document, with the possible exception of those broadcast during the interval;
2° Or, for a number of screenings not exceeding 500 and for a duration not exceeding two days of the same film week, to any work or document ;
3° Or, for a number of screenings not exceeding 30 and for an unlimited duration, to any work or document. This number is increased to 100 for works or documents in the documentary genre.
The same work or the same document may only obtain one cinema licence issued in application of this sub-section.
Prior to issuing a cinematographic exhibition licence, in the cases referred to in 2° and 3°, the Minister responsible for culture may seek the opinion of experts in the film industry, particularly from the fields of directing, production, distribution and exhibition, in order to assess the consequences of issuing the licence on the balance of the supply of cinematographic shows in the territory or territories concerned, with regard to the interest of showing the works.
