Subject to having submitted a declaration to the Prefect or the Minister responsible for sports for the activities mentioned in 1° and 2° of article R. 212-91 and for the activity of mountain leader, under the conditions laid down in the present article, nationals of a Member State of the European Union or another State party to the Agreement on the European Economic Area legally established in another Member State may carry out on national territory all or some of the activities mentioned in article L. 212-1, on a temporary and occasional basis and without being established there, nationals of a Member State of the European Union or of another State party to the Agreement on the European Economic Area who are legally established in one of these States to carry out the same activities and who, where neither these activities nor the training leading to them are regulated there, have carried them out in one or more Member States on a full-time basis for at least one year or on a part-time basis for an equivalent total period, during the ten years prior to providing the service.
The competent prefect is that of the département where the declarant intends to provide the majority of the service. However, when the declaration concerns activities taking place in a specific environment within the meaning of the provisions of article L. 212-7, the Minister responsible for sports is competent for the activities mentioned in 1° and 2° of article R. 212-91 and for the activity of mountain leader. He designates by decree the competent prefect for the other activities taking place in a specific environment within the meaning of article L. 212-7.
The declaration is renewed every year. The prefect, or the minister responsible for sport for the activities mentioned in 1° and 2° of article R. 212-91 and for the activity of mountain leader, is informed of any change in any of the elements included in the declaration.
The documents required for the declaration of the first service and for its renewal are set by order of the Minister for Sport.
