Article R2141-21 of the French Public Health Code

Only medical biology laboratories authorised for the activities mentioned in c and d of 2° of article R. 2142-1 may store gametes for donation.

If the laboratory, under whose responsibility consent was obtained under the conditions set out in article R. 2141-20, is not authorised to store gametes for donation, it shall hand them over to an authorised centre. It shall also send the centre a copy of the file of the person concerned, under conditions designed to guarantee the confidentiality of the information contained therein.

The anonymisation of the donor’s file and the allocation of the unique European code are carried out by the centre authorised to store gametes for donation.

Article R2141-21

Seuls les laboratoires de biologie médicale autorisés pour les activités mentionnées au c et au d du 2° de l’article R. 2142-1 peuvent conserver les gamètes en vue de don.

Si le laboratoire, sous la responsabilité duquel le consentement a été recueilli dans les conditions fixées à l’article R. 2141-20 n’est pas autorisé à conserver des gamètes en vue de don, il les remet à un centre autorisé. Il lui transmet également la copie du dossier de la personne concernée, dans les conditions propres à garantir la confidentialité des informations qu’il contient.

L’anonymisation du dossier du donneur ainsi que l’attribution du code européen unique sont réalisées par le centre autorisé à conserver des gamètes en vue de don.
