Article R2141-36 of the French Public Health Code

The age conditions required by article L. 2141-2 to benefit from the removal or collection of gametes, with a view to medically assisted procreation, are set as follows:

1° Oocytes may be retrieved from a person until their forty-third birthday;

2° Sperm may be retrieved from a person until their sixtieth birthday.

These provisions apply to the removal or collection of gametes or germ tissue carried out in application of article L. 2141-11, when this is carried out with a view to subsequent medically assisted procreation.

Les conditions d’âge requises par l’article L. 2141-2 pour bénéficier d’un prélèvement ou recueil de ses gamètes, en vue d’une assistance médicale à la procréation, sont fixées ainsi qu’il suit :

1° Le prélèvement d’ovocytes peut être réalisé chez une personne jusqu’à son quarante-troisième anniversaire ;

2° Le recueil de spermatozoïdes peut être réalisé chez une personne jusqu’à son soixantième anniversaire.

Ces dispositions sont applicables au prélèvement ou au recueil de gamètes ou de tissus germinaux effectué en application de l’article L. 2141-11, lorsque celui-ci est effectué en vue d’une assistance médicale à la procréation ultérieure.
