The presentation report also includes, where applicable, the following information:

1° The reasons for having recourse to a contract awarded without prior advertising or competitive tendering, to the procedure with negotiation or to the competitive dialogue ;

2° The reasons why the contracting authority has not allocated the contract, if it has not indicated them in the consultation documents;

3° The reasons why a minimum annual turnover in excess of the ceiling set in articles R. 2142-6 to R. 2142-12 has been required, if these have not been indicated in the consultation documents;

4° The reasons why the contracting authority has requested the use of means of communication other than electronic means for the transmission of tenders;

5° A description of the appropriate measures taken by the contracting authority to ensure that competition has not been distorted by prior studies and exchanges with economic operators or by the participation of an economic operator in the preparation of the contract pursuant to Articles R. 2111-1 and R. 2111-2;

6° Any conflicts of interest identified and the measures taken as a result;

7° The reasons why the contracting authority has decided not to award a contract or not to set up a dynamic purchasing system.

Le rapport de présentation comporte en outre, lorsqu’il y a lieu, les éléments suivants :

1° Les motifs du recours à un marché passé sans publicité ni mise en concurrence préalables, à la procédure avec négociation ou au dialogue compétitif ;

2° Les motifs pour lesquels le pouvoir adjudicateur n’a pas alloti le marché, s’il ne les a pas indiqués dans les documents de la consultation ;

3° Les raisons pour lesquelles un chiffre d’affaires annuel minimal supérieur au plafond fixé aux articles R. 2142-6 à R. 2142-12 a été exigé, lorsque celles-ci n’ont pas été indiquées dans les documents de la consultation ;

4° Les raisons pour lesquelles le pouvoir adjudicateur a sollicité l’utilisation de moyens de communication autres que les moyens électroniques pour la transmission des offres ;

5° La description des mesures appropriées prises par le pouvoir adjudicateur pour s’assurer que la concurrence n’a pas été faussée par des études et échanges préalables avec des opérateurs économiques ou par la participation d’un opérateur économique à la préparation du marché en application des articles R. 2111-1 et R. 2111-2 ;

6° Les conflits d’intérêts décelés et les mesures prises en conséquence ;

7° Les raisons pour lesquelles le pouvoir adjudicateur a renoncé à passer un marché ou à mettre en place un système d’acquisition dynamique.
