Article R2196-1 of the French Public procurement code

On its buyer profile, the purchaser offers free, direct and complete access to the essential data for contracts meeting a need whose value is equal to or greater than €40,000 excluding tax.

This essential data concerns :

1° The procedure for awarding the contract;

2° The content of the contract;

3° The performance of the contract, in particular, where applicable, its modification.

An Order of the Minister for the Economy, which is annexed to this Code, sets out the list of essential information and the procedures for its publication.

The provisions of this article also apply to contracts concluded in application of article R. 2122-8, the value of which is equal to or greater than 25,000 euros excluding tax. However, for these same contracts, the purchaser may satisfy this information obligation by publishing during the first quarter of each year, on the medium of its choice, the list of these contracts concluded the previous year. This list shall mention the subject, the amount excluding taxes and the date on which the contract was concluded, as well as the name of the successful tenderer and its postcode if it is established in France, or the country of its main establishment if it is not established in France.

L’acheteur offre, sur son profil d’acheteur, un accès libre, direct et complet aux données essentielles des marchés répondant à un besoin dont la valeur est égale ou supérieure à 40 000 euros hors taxes.

Ces données essentielles portent sur :

1° La procédure de passation du marché ;

2° Le contenu du contrat ;

3° L’exécution du marché, notamment, lorsqu’il y a lieu, sur sa modification.

Un arrêté du ministre chargé de l’économie qui figure en annexe au présent code fixe la liste de ces données essentielles ainsi que les modalités de leur publication.

Les dispositions du présent article sont également applicables aux marchés conclus en application de l’article R. 2122-8 dont la valeur est égale ou supérieure à 25 000 euros hors taxes. Toutefois, pour ces mêmes marchés, l’acheteur peut satisfaire à cette obligation d’information en publiant au cours du premier trimestre de chaque année, sur le support de son choix, la liste de ces marchés conclus l’année précédente. Cette liste mentionne l’objet, le montant hors taxes et la date de conclusion du marché ainsi que le nom de l’attributaire et son code postal s’il est établi en France, ou le pays de son principal établissement, s’il n’est pas établi en France.
