Article R2315-31-1 of the French Labour Code

The annual surplus from the operating budget may be transferred to the budget for social and cultural activities in accordance with article L. 2315-61, up to a limit of 10% of this surplus.

This sum and the arrangements for its use are recorded in the annual accounts of the social and economic committee or, where applicable, in the documents referred to in article L. 2315-65 and in the report referred to in article L. 2315-69.

L’excédent annuel du budget de fonctionnement peut être transféré au budget destiné aux activités sociales et culturelles conformément à l’article L. 2315-61, dans la limite de 10 % de cet excédent.

Cette somme et ses modalités d’utilisation sont inscrites, d’une part, dans les comptes annuels du comité social et économique ou, le cas échéant, dans les documents mentionnés à l’article L. 2315-65 et, d’autre part, dans le rapport mentionné à l’article L. 2315-69.
