Article R2315-32 of the French Labour Code

In the absence of an agreement between the central committee and the works councils provided for in Article L. 2315-62 and in the absence of stipulations in the branch collective agreement, the court of first instance sets the amount of the operating subsidy that each works council must retrocede to the central committee with a view to constituting the latter’s operating budget.

A défaut d’accord entre le comité central et les comités d’établissement prévu à l’article L. 2315-62 et à défaut de stipulations dans la convention collective de branche, le tribunal judiciaire fixe le montant de la subvention de fonctionnement que doit rétrocéder chaque comité d’établissement au comité central en vue de constituer le budget de fonctionnement de ce dernier.
