Article R232-86-4 of the French Sports Code

The results of the investigations are set out in a written report. This report shall indicate, in particular, any facts that may constitute violations of the anti-doping rules or a criminal offence.

Where the investigation leads to the presumption of the existence of an anti-doping violation, the notification provided for in article R. 232-88 shall be made.

If this is not the case, the Secretary General of the Agency shall close the investigation. This decision is notified to the World Anti-Doping Agency, the International Federation concerned and the athlete’s National Anti-Doping Organisation, who are informed of the reasons for the decision.

The information obtained during the investigation may be taken into account in the preparation of the annual testing programme, in the planning of targeted testing and may be shared with any organisation that is a signatory to the World Anti-Doping Code.

Les résultats des enquêtes font l’objet d’un rapport écrit. Ce rapport indique notamment les faits relevés susceptibles de constituer des violations des règles relatives à la lutte contre le dopage ou une infraction pénale.

Lorsque l’enquête permet de présumer l’existence d’une violation des règles relatives à la lutte contre le dopage, il est procédé à la notification prévue à l’article R. 232-88.

Dans le cas contraire, le secrétaire général de l’agence prononce la clôture de l’enquête. Cette décision est notifiée à l’Agence mondiale antidopage, à la fédération internationale concernée et à l’organisation nationale antidopage du sportif, qui sont informés de ses motifs.

Les renseignements obtenus lors de l’enquête peuvent être pris en compte dans l’élaboration du programme annuel de contrôles, dans la planification de contrôles ciblés et être partagés avec toute organisation signataire du code mondial antidopage.
