Article R2322-2 of the French Public procurement code

The purchaser may award a contract without prior advertising or competitive tendering when either no applications or no tenders have been submitted within the prescribed period, or only inadmissible applications as defined in article R. 2344-4, or only unsuitable tenders as defined in article L. 2152-4, have been submitted. In these cases, the initial terms of the contract may not be substantially modified.
For contracts where the estimated value of the requirement exceeds the formal procedure thresholds, a report is sent to the European Commission if it so requests.

Article R2322-2

L’acheteur peut passer un marché sans publicité ni mise en concurrence préalables lorsque, soit aucune candidature ou aucune offre n’a été déposée dans les délais prescrits, soit seules des candidatures irrecevables définies à l’article R. 2344-4, soit seules des offres inappropriées définies à l’article L. 2152-4, ont été présentées. Les conditions initiales du marché ne peuvent alors être substantiellement modifiées.
Pour les marchés dont la valeur estimée du besoin est supérieure aux seuils de procédure formalisée, un rapport est communiqué à la Commission européenne si celle-ci le demande.
