Article R2322-4 of the French Public procurement code

The purchaser may award a contract without prior advertising or competitive tendering where the conditions for awarding the contract are not compatible with the minimum periods of urgency provided for in articles R. 2361-2 and R. 2361-6 in the restricted invitation to tender procedure or in article R. 2361-8 in the procedure with negotiation, and the purpose of which is strictly limited to the measures necessary to deal with a pressing emergency resulting from unforeseeable and external circumstances, in particular technological or natural disasters.
Where the pressing urgency is incompatible with the preparation of the consultation documents, the award of the contract shall at least be the subject of an exchange of letters.

L’acheteur peut passer un marché sans publicité ni mise en concurrence préalables lorsque les conditions de passation ne sont pas compatibles avec les délais minimaux d’urgence prévus aux articles R. 2361-2 et R. 2361-6 dans la procédure d’appel d’offres restreint ou à l’article R. 2361-8 dans la procédure avec négociation, et dont l’objet est strictement limité aux mesures nécessaires pour faire face à une urgence impérieuse résultant de circonstances imprévisibles et extérieures, notamment les catastrophes technologiques ou naturelles.
Lorsque l’urgence impérieuse est incompatible avec la préparation des documents de la consultation, la passation du marché fait au moins l’objet d’un échange de lettres.
