Article R2333-105 of the French General Code of Local Authorities

I. – The fee payable each year to a municipality for the occupation of the municipal public domain by the works of the public electricity transmission and distribution networks is set by the municipal council within the following ceilings:

PR = 153 euros for municipalities with a population less than or equal to 2,000;

PR = (0.183 P – 213) euros for municipalities with a population greater than 2,000 and less than or equal to 5,000;

PR = (0.381 P – 1,204) euros for municipalities with a population greater than 5,000 and less than or equal to 20,000 ;

PR = (0.534 P – 4,253) euros for municipalities with a population of more than 20,000 and less than or equal to 100,000;

PR = (0.686 P – 19,498) euros for municipalities with a population of more than 100,000,

where P represents the unduplicated population of the municipality as resulting from the latest census published by the Institut national de la statistique et des études économiques (INSEE).

The fee ceilings mentioned in this article change on 1 January each year, in proportion to the change in the engineering index, defined in the Journal officiel of 1 March 1974, measured over the twelve months preceding the publication of the index known on 1 January.

II. – The fee payable each year to a public establishment for inter-municipal cooperation or a mixed syndicate for the occupation of its public domain by the works of the public electricity transport and distribution networks is set by the community council or the syndicate committee.

The fee is calculated for each member commune, within the limits of the ceilings mentioned in I, in proportion to the length of the networks installed on the public domain of the public establishment for inter-communal cooperation or the mixed syndicate in relation to the total length of the networks installed on the territory of the commune concerned.

I. – La redevance due chaque année à une commune pour l’occupation du domaine public communal par les ouvrages des réseaux publics de transport et de distribution d’énergie électrique est fixée par le conseil municipal dans la limite des plafonds suivants :

PR = 153 euros pour les communes dont la population est inférieure ou égale à 2 000 habitants ;

PR = (0,183 P – 213) euros pour les communes dont la population est supérieure à 2 000 habitants et inférieure ou égale à 5 000 habitants ;

PR = (0,381 P – 1 204) euros pour les communes dont la population est supérieure à 5 000 habitants et inférieure ou égale à 20 000 habitants ;

PR = (0,534 P – 4 253) euros pour les communes dont la population est supérieure à 20 000 habitants et inférieure ou égale à 100 000 habitants ;

PR = (0,686 P – 19 498) euros pour les communes dont la population est supérieure à 100 000 habitants,

où P représente la population sans double compte de la commune telle qu’elle résulte du dernier recensement publié par l’Institut national de la statistique et des études économiques (INSEE).

Les plafonds de redevances mentionnés au présent article évoluent au 1er janvier de chaque année, proportionnellement à l’évolution de l’index ingénierie, défini au Journal officiel du 1er mars 1974, mesurée au cours des douze mois précédant la publication de l’index connu au 1er janvier.

II. – La redevance due chaque année à un établissement public de coopération intercommunale ou un syndicat mixte pour l’occupation de son domaine public par les ouvrages des réseaux publics de transport et de distribution d’énergie électrique est fixée par le conseil communautaire ou le comité syndical.

La redevance est calculée pour chaque commune membre, dans la limite des plafonds mentionnés au I, au prorata de la longueur des réseaux installés sur le domaine public de l’établissement public de coopération intercommunale ou du syndicat mixte par rapport à la longueur totale des réseaux installés sur le territoire de la commune concernée.
