Article R2333-121 of the French General Code of Local Authorities

The fee payable each year to a municipality for the occupation of the municipal public domain by water supply and sewerage works is determined by the municipal council within the limits of a ceiling set at 1 January 2010 at 30 euros per kilometre of network, excluding connections, and 2 euros per square metre of floor space for non-linear built structures, excluding sewerage network manholes.

These ceilings change on 1 January each year, in proportion to the change in the “engineering” index, defined in the Journal officiel of 1 March 1974 and published in the Bulletin officiel du ministère chargé de l’équipement, measured over the twelve months preceding the publication of the index known on 1 January.

La redevance due chaque année à une commune pour l’occupation du domaine public communal par les ouvrages des services de distribution d’eau et d’assainissement est déterminée par le conseil municipal dans la limite d’un plafond fixé au 1er janvier 2010 à 30 euros par kilomètre de réseau, hors les branchements, et à 2 euros par mètre carré d’emprise au sol pour les ouvrages bâtis non linéaires, hors les regards de réseaux d’assainissement.

Ces plafonds évoluent au 1er janvier de chaque année, proportionnellement à l’évolution de l’index “ingénierie”, défini au Journal officiel du 1er mars 1974 et publié au Bulletin officiel du ministère chargé de l’équipement, mesurée au cours des douze mois précédant la publication de l’index connu au 1er janvier.
