The composition of the consortium may be changed up to the date of signature of the public contract, in the event of a company restructuring operation, in particular a takeover, merger or acquisition, or if the consortium provides proof that one of its members is unable to carry out its task for reasons for which it is not responsible. The consortium may ask the purchaser for authorisation to continue to take part in the award procedure by proposing, where appropriate, and subject to acceptance by the purchaser, one or more new members of the consortium, subcontractors or affiliated undertakings. The purchaser will decide on this request after examining the capacity of all the members of the grouping thus transformed and, where applicable, of the subcontractors or associated companies presented for acceptance, in the light of the conditions for participation which it has defined.

La composition du groupement peut être modifiée jusqu’à la date de signature du marché public, en cas d’opération de restructuration de société, notamment de rachat, de fusion ou d’acquisition, ou si le groupement apporte la preuve qu’un de ses membres se trouve dans l’impossibilité d’accomplir sa tâche pour des raisons qui ne sont pas de son fait. Le groupement peut demander à l’acheteur l’autorisation de continuer à participer à la procédure de passation en proposant, le cas échéant, à l’acceptation de l’acheteur, un ou plusieurs nouveaux membres du groupement, sous-contractants ou entreprises liées. L’acheteur se prononce sur cette demande après examen de la capacité de l’ensemble des membres du groupement ainsi transformé et, le cas échéant, des sous-contractants ou entreprises liées présentés à son acceptation, au regard des conditions de participation qu’il a définies.
