Article R2344-7 of the French Public procurement code

The purchaser shall verify the right of economic operators from countries outside the European Union or the European Economic Area who have not been excluded pursuant to the last paragraph of Article R. 2344-6 to participate in the award procedure in the light of the accessibility criteria set out in the notice of the call for competition.
As soon as it has made its decision, the purchaser shall inform the economic operators from countries outside the European Union or the European Economic Area who have requested authorisation to take part in the procedure, in writing and giving reasons.

Article R2344-7

L’acheteur vérifie le droit des opérateurs économiques des pays tiers à l’Union européenne ou à l’Espace économique européen qui n’ont pas été écartés en vertu du dernier alinéa de l’article R. 2344-6 à participer à la procédure de passation au regard des critères d’accessibilité figurant dans l’avis d’appel à concurrence.
Dès qu’il a pris sa décision, l’acheteur en informe par écrit et de manière motivée les opérateurs économiques des pays tiers à l’Union européenne ou à l’Espace économique européen qui ont sollicité l’autorisation de participer à la procédure.
