Article R2362-18 of the French Labour Code

The court with jurisdiction to rule on a challenge to the appointment and election of the members of the special negotiating body is that in whose jurisdiction is situated either the registered office of the European Cooperative Society, the legal entity, the subsidiary or the establishment concerned, as the case may be, or the domicile of the natural person participating in the formation of the European Cooperative Society.

The objection is lodged, investigated and judged in accordance with the procedures laid down in articles R. 2324-24 and R. 2324-25.

However, the dispute is lodged :

1° Within fifteen days of notification of the appointment to the employer ;

2° By the employees, within a period of fifteen days, from the date on which the appointment to the employer or the election is brought to their attention.

Le tribunal judiciaire compétent pour statuer sur la contestation de la désignation et de l’élection des membres du groupe spécial de négociation est celui dans le ressort duquel est situé soit le siège, selon le cas, de la société coopérative européenne, de la personne morale, de la filiale ou de l’établissement concerné, soit le domicile de la personne physique participant à la constitution de la société coopérative européenne.

La contestation est formée, instruite et jugée selon les modalités prévues aux articles R. 2324-24 et R. 2324-25.

Toutefois, la contestation est formée :

1° Dans un délai de quinze jours à compter de la notification de la désignation à l’employeur ;

2° Par les salariés, dans un délai de quinze jours, à compter de la date à laquelle la désignation à l’employeur ou l’élection est portée à leur connaissance.
