Article R2391-5 of the French Public procurement code

The purchaser may increase the amount of the advance payment above 30% of the amount calculated in accordance with the provisions of article R. 2391-4. In this case, it may make payment conditional upon the provision of a first demand guarantee. This guarantee may cover all or part of the advance payment. The two parties may agree to substitute this guarantee with a personal and joint guarantee. The provision of this guarantee may not, however, be required of public entities holding a contract.

L’acheteur peut porter le montant de l’avance au-delà de 30 % du montant calculé conformément aux dispositions de l’article R. 2391-4. Il peut alors en conditionner le versement à la constitution d’une garantie à première demande. Cette garantie peut porter sur tout ou partie de l’avance. Les deux parties peuvent s’accorder pour substituer à cette garantie une caution personnelle et solidaire. La constitution de cette garantie ne peut toutefois être exigée des personnes publiques titulaires d’un marché.
