Article R2531-26 of the French General Code of Local Authorities

In the event of the death or resignation of an elected full member or the loss of the capacity in respect of which he was elected, he is replaced by his alternate.

If, for reasons of the same nature, the alternate is unable to sit, the first non-elected full member candidate in the order of presentation of the list is called upon. However, for the replacement of either the president of a community or agglomeration union, or the president of another grouping of municipalities, only a candidate with the same capacity may be called upon in this order of presentation.

When a replacement cannot be made in accordance with the procedure laid down in the previous paragraph before the twelfth month preceding the general renewal of the municipal councils, by-elections are held within three months; all the members of the corresponding college take part in the vote.

En cas de décès ou de démission d’un membre titulaire élu ou de la perte de la qualité au titre de laquelle il a été élu, il est remplacé par son suppléant.

Si, pour des motifs de même nature, le suppléant n’est pas en mesure de siéger, il est fait appel au premier candidat titulaire non élu dans l’ordre de présentation de la liste. Toutefois, pour le remplacement soit d’un président de communauté ou de syndicat d’agglomération, soit d’un président d’un autre groupement de communes, il ne peut être fait appel dans cet ordre de présentation qu’à un candidat ayant la même qualité.

Lorsqu’il ne peut être procédé à un remplacement selon les modalités prévues à l’alinéa précédent avant le douzième mois précédant le renouvellement général des conseils municipaux, il est procédé dans un délai de trois mois à des élections partielles ; l’ensemble des membres du collège correspondant prend part au scrutin.
