Article R2614-2 of the French Public procurement code

The Assembly of French Guyana or the Departmental Council of Mayotte decides on the financial programming of the operations mentioned in article R. 2614-1, on the proposal of the Prefect. The State may entrust to the local authority, after a declaration of public interest has been made and where this procedure is necessary, all or part of the following project management responsibilities:
1° Conducting land acquisitions in the name and on behalf of the State;
2° Preparing, concluding and managing contracts;
3° Taking delivery of the work, after prior agreement from the Prefect;
4° Taking legal action in the name and on behalf of the State, after agreement from the latter.

Article R2614-2

L’assemblée de Guyane ou le conseil départemental de Mayotte arrête la programmation financière des opérations mentionnées à l’article R. 2614-1, sur proposition du préfet. L’Etat peut confier à la collectivité après déclaration d’utilité publique, lorsque cette procédure est nécessaire, tout ou partie des attributions suivantes de la maîtrise d’ouvrage :
1° Conduite des acquisitions foncières au nom et pour le compte de l’Etat ;
2° Préparation, passation et gestions des contrats ;
3° Réception de l’ouvrage, après accord préalable du préfet ;
4° Action en justice au nom et pour le compte de l’Etat, après accord de ce dernier.
