For the application of articles R. 2172-15 and R. 2172-18 in Guadeloupe, French Guiana, Martinique, Mayotte and La Réunion, the words: “regional director of cultural affairs” are replaced by the words: “director of cultural affairs” and in Mayotte the words: “regional prefect” by the words: “State representative”.
French Guiana, Martinique and Mayotte may come under the jurisdiction of an inter-regional or inter-departmental committee provided for in article R. 2197-3.
The State may, at their request, entrust French Guyana and Mayotte with part of the responsibility for project management, when these local authorities award contracts for the purpose of carrying out development work on the national network, as referred to in article L. 2614-1, financed in accordance with the provisions of 2° of A of article L. 4434-1 of the General Local Authorities Code.
The Assembly of French Guyana or the Departmental Council of Mayotte decides on the financial programming of the operations mentioned in article R. 2614-1, on the proposal of the Prefect. Draft contracts and any amendments thereto must be approved in writing by the Prefect prior to signature. In the absence of a response within fifteen days of the reasoned proposal from the territorial collectivity of French Guyana or the Department of Mayotte, the agreement is deemed to have been reached.
The territorial collectivity of French Guyana or the Department of Mayotte is responsible for the payment of all expenditure relating to development operations on the national road network carried out in application of this chapter.
The State departments concerned remain in charge of the operations defined in article R. 2614-4.
For each operation, an agreement between the Prefect and the President of the Assembly of French Guyana or the Departmental Council of Mayotte defines the content of the project management powers entrusted to the local authority and the organisation of the project management.
