Article R2651-4 of the French Public procurement code

For the application of the regulatory provisions of Book III to the Wallis and Futuna Islands:
1° In article R. 2311-5 :
a) 2° is deleted ;
b) In 6°, the words: “other technical standards drawn up by European standardisation bodies, or, in their absence,” are deleted;
2° The second paragraph of Article R. 2322-2 is deleted;
3° Articles R. 2331-1 and R. 2331-2 are replaced by the following provisions:

“Art. R. 2331-1 -Buyers may make known their intention to award a contract by publishing a pre-information notice.

“Art. R. 2331-2. -This notice is published either in the Bulletin officiel des annonces de marchés publics or on the contracting authority’s buyer profile.
“The buyer profile is the dematerialisation platform enabling purchasers to make consultation documents available to economic operators electronically and to receive documents sent by candidates and tenderers electronically. An order issued by the Minister for the Economy determines the functions and minimum requirements for buyer profiles. ” ;

4° Article R. 2331-8 reads as follows:

“Art. R. 2331-8 -The provisions of article R. 2131-16 apply”;

5° In article R. 2343-3, references to articles L. 5212-1 to L. 5212-11 of the Labour Code are replaced by references to locally applicable provisions having the same purpose;
6° In article R. 2351-12, the words: “within the meaning of the Commission Recommendation of 6 May 2003 concerning the definition of micro, small and medium-sized enterprises” and the words: “within the meaning of Article 19 I of amended law no. 96-603 of 5 July 1996 relating to the development and promotion of trade and craft trades” are replaced by the words: “within the meaning of locally applicable regulations”;
7° Article R. 2352-3 reads as follows:

“Art. R. 2352-3 – The provisions of article R. 2152-4 apply”;

8° In Article R. 2371-6, the reference to the Prefect is replaced by the reference to the Senior Administrator;
9° The second paragraph of Article R. 2383-1 reads as follows:

“This notice is published in the Bulletin officiel des annonces de marchés publics. “
10° Article R. 2383-2 reads as follows:

“Art. R. 2383-2 -The provisions of article R. 2183-3 apply. ” ;

11° Article R. 2384-4 reads as follows:

“Art. R. 2384-4 -The provisions of Article R. 2184-5 apply. ” ;

11° bis The first sentence of the second paragraph of Article R. 2392-3 is only applicable if the contract holders or their subcontractors eligible for direct payment choose to send their invoices in electronic form;

11° ter In Article R. 2392-12-1, the words: “à L. 2392-3” are replaced by the words: “et L. 2392-2” ;

12° In article R. 2393-18, the words: “in the Official Journal of the European Union under the conditions of articles R. 2131-19 and R. 2331-11” are replaced by the words: “in the Official Journal of the Territory of the Wallis and Futuna Islands”.

Pour l’application des dispositions réglementaires du livre III aux îles Wallis et Futuna :
1°° A l’article R. 2311-5 :
a) Le 2° est supprimé ;
b) Au 6° les mots : ” les autres référentiels techniques élaborés par les organismes européens de normalisation, ou, en leur absence, ” sont supprimés ;
2° A l’article R. 2322-2, le second alinéa est supprimé ;
3° Les articles R. 2331-1 et R. 2331-2 sont remplacés par les dispositions suivantes :

” Art. R. 2331-1.-Les acheteurs peuvent faire connaître leur intention de passer un marché par le biais de la publication d’un avis de pré-information.

” Art. R. 2331-2. -Cet avis est publié soit dans le Bulletin officiel des annonces de marchés publics soit sur le profil acheteur du pouvoir adjudicateur.
” Le profil d’acheteur est la plateforme de dématérialisation permettant notamment aux acheteurs de mettre les documents de la consultation à disposition des opérateurs économiques par voie électronique et de réceptionner par voie électronique les documents transmis par les candidats et les soumissionnaires. Un arrêté du ministre chargé de l’économie détermine les fonctionnalités et les exigences minimales qui s’imposent aux profils d’acheteur. ” ;

4° L’ article R. 2331-8 est ainsi rédigé :

” Art. R. 2331-8.-Les dispositions de l’article R. 2131-16 s’appliquent ” ;

5° A l’article R. 2343-3, les références aux articles L. 5212-1 à L. 5212-11 du code du travail sont remplacées par les références aux dispositions applicables localement ayant le même objet ;
6° A l’article R. 2351-12, les mots : “ au sens de la recommandation de la Commission du 6 mai 2003 concernant la définition des micro, petites et moyennes entreprises ” et les mots : “ au sens du I de l’article 19 de la loi n° 96-603 du 5 juillet 1996 modifiée relative au développement et à la promotion du commerce et de l’artisanat ” sont remplacés par les mots : “ au sens de la réglementation localement applicable ” ;
7° L’article R. 2352-3 est ainsi rédigé :

” Art. R. 2352-3.-Les dispositions de l’article R. 2152-4 s’appliquent ” ;

8° A l’article R. 2371-6, la référence au préfet est remplacée par la référence à l’administrateur supérieur ;
9° Le second alinéa de l’article R. 2383-1 est ainsi rédigé :

“ Cet avis est publié dans le Bulletin officiel des annonces de marchés publics. ”
10° L’ article R. 2383-2 est ainsi rédigé :

” Art. R. 2383-2.-Les dispositions de l’article R. 2183-3 s’appliquent. ” ;

11° L’article R. 2384-4 est ainsi rédigé :

” Art. R. 2384-4.-Les dispositions de l’article R. 2184-5 s’appliquent. ” ;

11° bis La première phrase du deuxième alinéa de l’article R. 2392-3 n’est applicable que si les titulaires de marchés ou leurs sous-traitants admis au paiement direct choisissent de transmettre leurs factures sous forme électronique ;

11° ter A l’article R. 2392-12-1, les mots : “à L. 2392-3” sont remplacés par les mots : “et L. 2392-2” ;

12° A l’article R. 2393-18, les mots : ” au Journal officiel de l’Union européenne dans les conditions des articles R. 2131-19 et R. 2331-11 ” sont remplacés par les mots : ” au Journal officiel du Territoire des îles Wallis et Futuna “.
