Article R294 of the French Code of Criminal Procedure

I.-The first two paragraphs of article R. 69 are worded as follows:

“The clerk of the court of first instance of the place of birth, for natural persons, and of the place of the registered office of the company or establishment, for legal persons, as soon as he is notified, shall enter on the forms the particulars prescribed in articles 769 et 769-1.

“The notice is sent as soon as possible to the public prosecutor or, in accordance with the second paragraph of Article R. 62, to the automated national criminal record service. “

II.-The other amendments to Article R. 69 are as follows:

-in 4°, the words: “by the Minister of the Interior” are replaced by the words: “by the authority from which they emanate”;

-in 6°, the words: “by the accountants of the Directorate General of Public Finance” are replaced by the words: “by the agent responsible for collecting fines”.

III.-The last paragraph is deleted.

I.-Les deux premiers alinéas de l’article R. 69 sont rédigés comme suit :

” Le greffier du tribunal de première instance du lieu de naissance, pour les personnes physiques, et du lieu du siège de l’entreprise ou de l’établissement, pour les personnes morales, dès qu’il est avisé, inscrit sur les fiches les mentions prescrites aux articles 769 et 769-1.

” L’avis est adressé dans le plus bref délai au procureur de la République ou, conformément au second alinéa de l’article R. 62, au service du casier judiciaire national automatisé. ”

II.-Les autres modifications apportées à l’article R. 69 sont les suivantes :

-au 4°, les mots : ” par le ministre de l’intérieur ” sont remplacés par les mots : ” par l’autorité dont elles émanent ” ;

-au 6°, les mots : ” par les comptables de la direction générale des finances publiques ” sont remplacés par les mots : ” par l’agent chargé du recouvrement des amendes “.

III.-Le dernier alinéa est supprimé.
