Article R312-22 of the French Sports Code

The National Sports Venue Safety Commission is chaired by the Minister for Sport or his representative. In addition to its chairman, it comprises:

1° Seven representatives of the State, ex officio members:

a) One representative of the Minister for Construction ;

b) Three representatives of the Minister of the Interior;

c) One representative of the Minister for Health;

d) Two representatives of the Minister for Sport;

2° Five members appointed by order of the Minister for Sport:

a) Two members appointed on the proposal of the French National Olympic and Sports Committee, representing the sports movement;

b) One member nominated by the Association of French Mayors;

c) One member nominated by the most representative body of sports facility construction professionals;

d) One member, appointed on the recommendation of the Minister responsible for construction, belonging to a public establishment of the State carrying out its mission, in particular, in the field of the soundness and safety of buildings.

In addition, a representative of the municipal police authority responsible for the sports venue in question is entitled to sit on the committee and vote.

The committee may not validly deliberate without the presence of the representative of the municipal police authority, a representative of the Minister of Sport, a representative of the Minister of the Interior and a representative of the Minister of Construction.

For each full member appointed under 2°, an alternate is appointed under the same conditions.

The Chairman has the casting vote in the event of a tie.

Article R312-22

La Commission nationale de sécurité des enceintes sportives est présidée par le ministre chargé des sports ou son représentant. Elle comprend outre son président :

1° Sept représentants de l’Etat, membres de droit :

a) Un représentant du ministre chargé de la construction ;

b) Trois représentants du ministre de l’intérieur ;

c) Un représentant du ministre chargé de la santé ;

d) Deux représentants du ministre chargé des sports ;

2° Cinq membres nommés par arrêté du ministre chargé des sports :

a) Deux membres désignés sur proposition du Comité national olympique et sportif français représentant le mouvement sportif ;

b) Un membre désigné sur proposition de l’Association des maires de France ;

c) Un membre désigné sur proposition de l’organisme le plus représentatif des professionnels de la construction d’équipements sportifs ;

d) Un membre, désigné sur proposition du ministre chargé de la construction, appartenant à un établissement public de l’Etat exerçant sa mission, notamment, dans le domaine de la solidité et de la sécurité des constructions.

Siège en outre de plein droit, avec voix délibérative, un représentant de l’autorité investie du pouvoir de police municipale sur l’enceinte sportive concernée.

La commission ne peut valablement délibérer hors de la présence du représentant de l’autorité investie du pouvoir de police municipale, d’un représentant du ministre chargé des sports, d’un représentant du ministre de l’intérieur et d’un représentant du ministre chargé de la construction.

Pour chaque membre titulaire désigné en application du 2°, un suppléant est nommé dans les mêmes conditions.

Le président a voix prépondérante en cas de partage.
