TITLE I: SPORTS FACILITIES

Within the meaning of article L. 312-2, a sports facility is any immovable property belonging to a public or private person, specially fitted out or used, on a permanent or temporary basis, with a view to practising sport and open to users, whether free of charge or in return for payment.

Any owner of a sports facility must declare it to the Prefect of the département in which the facility is located within three months of it being brought into service. The declarations provided for in article R. 312-3 must identify : 1° In all cases, the sports facility, its use and its characteristics, as well as its owner and, where applicable, its operator; 2° In the event of modifications to the declared data, the nature of the modifications planned or carried out; 3° In the event of a transfer, the transferee and, where applicable, the intended use of the property….

Local authorities, their groupings, the French National Olympic and Sports Committee and its decentralised bodies and approved sports federations within the meaning of article L. 131-8 and their decentralised bodies contribute to updating the database created, in application of article L. 312-2, from the information contained in the declarations. To this end, they may enter into an agreement with the State.

The percentage referred to in article L. 312-3 is set at 20% of the expenditure likely to be subsidised or, in the absence of such expenditure, 20% of the total cost excluding taxes of the sports facility.

Failure to comply with the reporting obligations set out in articles R. 312-3 and R. 312-4 is punishable by a second-class fine.
