Article R312-8 of the French Sports Code

For the purposes of this section :

1° Sports arenas are establishments open to the public, within the meaning of article R. 143-2 of the Code de la Construction et de l’Habitation (Building and Housing Code), to which access can be permanently controlled and which include fixed or temporary stands;

2° A fixed stand is one that remains in place for more than three consecutive months; otherwise, it is a temporary stand;

3° The capacity is the number of individualised seats offered to spectators in the fixed stands and likely to be offered in the temporary stands;

4° The maximum number of spectators is the number of seats that can be offered to spectators, on the one hand, in the fixed stands and in the temporary stands and, on the other hand, standing places that can be offered outside these stands.

Pour l’application de la présente section :

1° Constituent des enceintes sportives les établissements recevant du public, au sens de l’article R. 143-2 du code de la construction et de l’habitation, dont l’accès est susceptible d’être contrôlé en permanence et qui comportent des tribunes fixes ou provisoires ;

2° Une tribune fixe est une tribune qui reste installée plus de trois mois consécutifs ; dans le cas contraire, il s’agit d’une tribune provisoire ;

3° La capacité d’accueil est le nombre de places assises individualisables offertes aux spectateurs dans les tribunes fixes et susceptibles d’être offertes dans des tribunes provisoires ;

4° L’effectif maximal des spectateurs est le nombre de places assises susceptibles d’être offertes aux spectateurs, d’une part, dans les tribunes fixes et dans les tribunes provisoires et, d’autre part, de places debout susceptibles d’être offertes hors de ces tribunes.
