Article R3124-5 of the French Public procurement code

The awarding authority sets the award criteria in descending order of importance. The ranking of the criteria is indicated in the concession notice, in the invitation to submit a tender or in any other consultation document.
Exceptionally, the awarding authority may change the order of the criteria to take account of the innovative nature of a solution presented in a tender. Such a change must not be discriminatory. A bid is considered to present an innovative solution when it includes an exceptional level of functional performance, and could not have been foreseen by a diligent conceding authority. The conceding authority publishes a new concession notice or sends out a new invitation to submit a tender within the deadlines set out in articles R. 3124-2 and R. 3124-3.

L’autorité concédante fixe les critères d’attribution par ordre décroissant d’importance. Leur hiérarchisation est indiquée dans l’avis de concession, dans l’invitation à présenter une offre ou dans tout autre document de la consultation.
L’autorité concédante peut modifier, à titre exceptionnel, l’ordre des critères pour tenir compte du caractère innovant d’une solution présentée dans une offre. Une telle modification ne doit pas être discriminatoire. Une offre est considérée comme présentant une solution innovante lorsqu’elle comporte des performances fonctionnelles d’un niveau exceptionnel, et qu’elle ne pouvait être prévue par une autorité concédante diligente. L’autorité concédante publie un nouvel avis de concession ou envoie une nouvelle invitation à présenter une offre dans le respect des délais fixés aux articles R. 3124-2 et R. 3124-3.
