Article R321-1-1 of the French Insurance Code

Each activity carried out by an insurance undertaking which undertakes both the risks referred to in 1° and 2° of Article L. 310-1 is managed separately, and organised in such a way that the life insurance activity and the non-life insurance activity are kept separate.

Where a non-life insurance undertaking has financial, commercial or administrative links with a life insurance undertaking, the Autorité de contrôle prudentiel et de résolution shall ensure that the accounts of the undertakings concerned are not distorted by agreements between those undertakings or by any arrangement likely to influence the allocation of expenses and income.

Chaque activité exercée par une entreprise d’assurance pratiquant à la fois les risques mentionnés au 1° et au 2° de l’article L. 310-1 fait l’objet d’une gestion distincte, organisée de telle sorte que l’activité d’assurance vie et l’activité d’assurance non-vie soient séparées.


Lorsqu’une entreprise d’assurance non-vie a des liens financiers, commerciaux ou administratifs avec une entreprise d’assurance vie, l’Autorité de contrôle prudentiel et de résolution veille à ce que les comptes des entreprises concernées ne soient pas faussés par des conventions passées entre ces entreprises ou par tout arrangement susceptible d’influencer la répartition des frais et des revenus.
