Article R321-33 of the French Insurance Code

To enable insurance undertakings that are party to a co-insurance transaction to benefit from the exemption provided for in article L. 321-12, the transaction must meet the following criteria:

1° The risk is covered by a single contract at a single premium for the same term;

2° The insurers are not jointly and severally liable;

3° One of the insurers is designated as the lead insurer: the lead insurer must fully assume its management role, in particular that of determining the terms and conditions of insurance and pricing.

Pour permettre aux entreprises d’assurance qui sont parties à une opération de coassurance de bénéficier de la dispense prévue à l’article L. 321-12, l’opération doit réunir les critères suivants :


1° Le risque est couvert par un contrat unique moyennant une prime globale pour une même durée ;


2° Les assureurs ne sont pas solidaires entre eux ;


3° L’un des assureurs est désigné en tant qu’apériteur : ce dernier doit assumer pleinement le rôle directeur qui lui revient et notamment celui de déterminer les conditions d’assurance et de tarification.
