Article R321-45 of the French Commercial code

The Government Commissioner is the addressee of complaints concerning the persons mentioned in I and II of article L. 321-4 as well as articles L. 321-24 and L. 321-28-1 and the persons authorised to direct sales.

The complaint shall mention:

-if it comes from a natural person, their surname, first names and address;

-if it comes from a legal entity, its name and registered office.

It specifies the surname and forename of the natural person or the name of the legal entity that is the subject of the complaint. It shall state the facts giving rise to the complaint.

It must be dated and sent by any means that confers a date certain.

Le commissaire du Gouvernement est destinataire des réclamations visant les personnes mentionnées aux I et II de l’article L. 321-4 ainsi qu’aux articles L. 321-24 et L. 321-28-1 et les personnes habilitées à diriger les ventes.


La réclamation mentionne :


-si elle émane d’une personne physique, ses nom, prénoms et domicile ;


-si elle émane d’une personne morale, sa dénomination et son siège social.


Elle précise les nom et prénom de la personne physique ou la dénomination de la personne morale mise en cause. Elle indique les faits à l’origine de la réclamation.


Elle est datée et adressée par tout moyen conférant date certaine.
