Article R322-11-3 of the French Insurance Code

Within two working days of receiving notification of a disposal or reduction in holding as referred to in Article R. 322-11-1, the Autorité de contrôle prudentiel et de résolution shall acknowledge receipt of the notification in writing to the declarant.

The Autorité de contrôle prudentiel et de résolution has sixty working days from receipt of this acknowledgement to inform the declarant and the undertaking concerned by the proposed transaction that, in view of the need to ensure sound and prudent management and to protect the interests of policyholders, this transaction calls into question the conditions to which authorisation is subject.

Dans un délai de deux jours ouvrables après réception de la notification d’une opération de cession ou de diminution de participation mentionnée à l’article R. 322-11-1, l’Autorité de contrôle prudentiel et de résolution en accuse réception par écrit au déclarant.

L’Autorité de contrôle prudentiel et de résolution dispose d’un délai de soixante jours ouvrables à compter de la réception de cet accusé de réception pour faire savoir au déclarant et à l’entreprise visée par l’opération envisagée que, compte tenu du besoin de garantir une gestion saine et prudente et d’assurer la protection des intérêts des assurés, cette opération remet en cause les conditions auxquelles est subordonné l’agrément.
