Article R3252-27 of the French Labour Code

Every month, the employer sends the court registry a sum equal to the portion of the salary that may be seized.

Where there is only one seizing creditor, payment is made by means of a cheque drawn up in accordance with the instructions given by the creditor. The court clerk will send the cheque to the creditor or his agent as soon as it is received, after noting it in the file. The employer may also make a transfer in accordance with the instructions given by the creditor. In this case, it is the employer’s responsibility to provide proof of the date and amount of the transfer to the court registry.

If there is more than one distraining creditor, payment is made by cheque or by transfer made payable to the registrar of the judicial court or, where applicable, to one of its local chambers.

L’employeur adresse tous les mois au greffe une somme égale à la fraction saisissable du salaire.


Lorsqu’il n’existe qu’un seul créancier saisissant, le versement est réalisé au moyen d’un chèque libellé conformément aux indications données par celui-ci. Le greffier l’adresse dès sa réception, et après mention au dossier, au créancier ou à son mandataire. L’employeur peut également procéder par virement, établi, conformément aux indications données par le créancier. Dans ce cas, il lui incombe de justifier auprès du greffe de la date et du montant du virement.


S’il existe plusieurs créanciers saisissants, le versement est fait par chèque ou par virement établi à l’ordre du régisseur installé auprès du greffe du tribunal judiciaire ou le cas échéant, de l’une de ses chambres de proximité.
