Article R333-3 of the French Sports Code

The rights referred to in the first paragraph of Article R. 333-2 are marketed by the league or the commercial company referred to inArticle L. 333-2-1 in accordance with a public and non-discriminatory call for tenders procedure open to all interested publishers or distributors of services.

The notice of call for tenders contains information about the content and expiry date of current contracts for other audiovisual exploitation rights. It also specifies the timetable for the award procedure and the arrangements for opening bids from the various candidates.

The rights are offered in several separate lots, the number and composition of which must take into account the objective characteristics of the markets on which they are offered for purchase.

Each lot is awarded to the candidate whose proposal is judged to be the best in the light of the criteria defined in advance in the invitation to tender. Contracts are concluded for a period which may not exceed five years.

The league or the commercial company referred to in article L. 333-2-1 must reject proposals for global or coupled bids as well as those that include a price supplement.

La commercialisation par la ligue ou la société commerciale mentionnée à l’article L. 333-2-1 des droits mentionnés au premier alinéa de l’article R. 333-2 est réalisée selon une procédure d’appel à candidatures publique et non discriminatoire ouverte à tous les éditeurs ou distributeurs de services intéressés.

L’avis d’appel à candidatures contient des informations relatives au contenu et à l’échéance des contrats en cours portant sur les autres droits d’exploitation audiovisuelle. Il précise également le calendrier de la procédure d’attribution et les modalités d’ouverture des offres des différents candidats.

Les droits sont offerts en plusieurs lots distincts dont le nombre et la constitution doivent tenir compte des caractéristiques objectives des marchés sur lesquels ils sont proposés à l’achat.

Chaque lot est attribué au candidat dont la proposition est jugée la meilleure au regard de critères préalablement définis dans l’avis d’appel à candidatures. Les contrats sont conclus pour une durée qui ne peut excéder cinq ans.

La ligue ou la société commerciale mentionnée à l’article L. 333-2-1 doit rejeter les propositions d’offres globales ou couplées ainsi que celles qui sont assorties d’un complément de prix.
